TERMS AND CONDITIONS

These Terms and Conditions (“Terms & Conditions/Terms”) are legally binding between you ("You") and Isha Foundation Australia Inc ("We" or "Us") for your registration to participate in “In Conversation with the Mystic - Layne Beachley with Sadhguru” (“event”) 

You agree that by registering for this event and accessing the website www.isha.sadhguru.org ("Site"), You have read, understood, and agreed to be bound by these Terms & Conditions.  If You do not agree with all of these Terms, then You are expressly prohibited from using the Site and you must discontinue use immediately.

You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at Our sole discretion. 

1. USER REGISTRATION: 

(i) The minimum age limit to participate in the event is 12 years. But no one under 18 years shall register for the event on his/her own or provide any personal information in this regard without parental consent.  

(ii) To register for the event, You must provide complete and accurate details/information as asked for in the registration page.  

(iii) Your registration for the event will be complete only after You receive a confirmation email, confirming Your registration and participation.  

(iv) The event registrations are subject to availability. 

2. Event GUIDELINES: 

You are expressly prohibited from photographing or recording, by video or audio, any part of the event for any purpose whatsoever. Any material obtained through such measures would be deemed to be a violation of our  Intellectual Property Rights. 

3. PAYMENT: 

The payment must be made in full, according to the chosen category, before the commencement of the event.

We accept the following mode of payments, i.e.Credit and Debit Cards.

In the event the prerequisites as mentioned in these Terms & Conditions are not fulfilled, We reserve the right to cancel Your registration and the refund will be done as per the cancellation and refund policy provided below.

4.   REFUND POLICY:  

  1. Tickets can be transferred or handed over to another person unless they were purchased under the student or senior categories. Such transfers can also be done as long as they meet the criteria the ticket was purchased under.

  2. No reselling of tickets is allowed. However, as stated above, ticket transfers without any commercial gain are permissible.

  3. For all cancellations made 5 or more days before the event, a 20% fee would be deducted from the ticket price and the remaining refunded. No refunds will be given after that.

  4. No refunds would be made if cancelled within 7 days of the event starting date.

  5. Please allow 14-28 days for the refund to be processed.  

  6. Tickets can be upgraded to a higher category upon payment of the difference in fee applicable at the time of the upgrade. Please contact our support teams for any upgrades. 

  7. No downgrading of tickets would be allowed.

  8. All refund requests must be made in writing to [email protected] . Cancellation & Refund requests raised by any other communication channels will not be accepted.

5. ADMISSION: 

We reserve the right to allow admission into the event and/cancellation of Your participation at Our sole discretion.  

6. CODE OF CONDUCT: 

You agree to behave in such a way as to create a safe, supportive, learning environment while at the event. You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drug. You agree not to engage in disruptive speech or behavior or otherwise interfere with the event or other individuals’ participation in the event. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability. Participants engaging or threatening to engage in such behavior will be requested to leave the event or related event immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the event. If You witness such behavior, please promptly contact the event volunteer in order to take appropriate action.

7. CODE OF BEHAVIOR - CONTINUED: 

Please note that the following activities are strictly prohibited and you may be to leave the event , equipment confiscated if found violating the following guidelines. 

No photography

No audio recordings

No videography

No derogatory social media posts - Engage in the event with a spirit that reflects the program's core values, representing a collective of people united by common principles and ideas. Fully integrate yourself as a vital part of the group, rather than staying as an observer on the sidelines. 

8. ASSUMPTION OF RISK: 

You acknowledge and agree that Your attendance and participation in the event is voluntary. Since attending any of the sessions could involve the physical activity of learning Yoga, You agree to assume the risks associated with attending and participating in the event to the fullest extent permitted under applicable law. To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your participation in the event.

9. INFORMATION ABOUT YOU: 

You consent to the collection and use of Your personal information that You provide in connection with the event, by Us.  We will use Your information to send details and announcements related to the event to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of Australia. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our Site. You agree that We may use any information that We obtain about You in accordance with the Provisions of Our Privacy Policy . Please read Our Privacy Policy carefully as it will help You make informed decisions about sharing Your personal information with Us. 

10. DISCLAIMER: 

The Site is provided on an as-is and as-available basis. You agree that Your use of the Site services will be at Your sole risk. To the fullest extent permitted by law, We disclaim all warranties, express or implied, in connection with the Site and Your use thereof, including, without limitation, fitness for a particular purpose and non-infringement. We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to this Site and We will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Site, (3) any unauthorized access to or use of Our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the Site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Site. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and We will not be a party to or in any way be responsible for monitoring any transaction between You and any third-party providers of products or services.

11. LICENSE TO USE ITEMS: 

In consideration of the opportunity to participate in the event, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional/educational purposes, all or any part of the following items ("Items"): (a) all still photographs (b) all audio and video recordings in connection with the event. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.

12. WAIVER OF LIABILITY: 

In consideration of being allowed to register for, and participate in the event, You hereby warrant and represent that You are at least 15 years of age with parental consent or above 18 years of age and freely waive, release from liability, assume all risks, and covenant not to sue Us  or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.

13. FORCE MAJEURE: 

In the event that it is made impossible or impracticable or illegal to proceed with or carry out this event in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, power disruption, technical difficulties, internet connectivity, materials unavailability, or any other cause(s) beyond reasonable control and as a result thereof, there may be delay, postponement, rescheduling, termination and/or cancellation of this event, and We will not be liable for any losses or damages incurred by You. 

14. GOVERNING LAW AND DISPUTE RESOLUTION

Each party irrevocably and unconditionally submits to the non exclusive jurisdiction of the State of Victoria.

15. LIMITATIONS OF LIABILITY

In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from Your use of the Site, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You for any cause whatsoever and regardless of the form of the action, will at all times be limited to the cost of the event. 

16. INDEMNIFICATION

You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of Your participation of the event and/or breach of these Terms & Conditions. 

Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
